A 30-day provisional test period gives you the option to try out Full Sail Partners Vision Unleashed™ (“Vision Unleashed”) service for free. Simply sign up with your e-mail address and company information and receive your 30-day provisional authorization code via email. After 15 days, you will receive an e-mail reminding you that your provisional period will be expiring and provide you a link to sign up for a year subscription. If you have not subscribed for the Vision Unleashed service you will receive daily e-mails starting 5 days before the end of your expiration date. If you do not renew your subscription, your service will terminate.
At the end of the 30-day provisional test period, your ability to try Vision Unleashed will expire. If you subscribe before your provisional expiration date, your provisional authorization code will become your subscription authorization code. If you subscribe after the expiration of your provisional period, you will receive a new authorization code via email.
There are no refunds or cancellations after the purchase of your subscription, so please fully test the system before you purchase. Also, the 30-day provisional test period will not be extended so please ensure you have time to test before signing up.
Renewal
At 30-days and 15-days before the end of your annual subscription, you will receive an e-mail at the e-mail address on file reminding you that your subscription will expire. To continue service, simply follow the link embedded in the e-mail to the purchase site.
If you have not already renewed service, you will receive daily e-mails starting 5 days before the end of your annual subscription. If you do not renew your subscription, your service will terminate on your anniversary date.
If you renew before the end of your subscription period, you will keep your authorization code. If you allow your subscription to expire, you will receive a new authorization code via e-mail
We do NOT store your credit card on file. You will be required to re-enter your payment information each time you subscribe for an annual service.
Your Obligations
You are solely responsible for the credit card and billing contact information you, your agents or Assignees, (as further defined herein) provide to Full Sail Partners. You acknowledge and agree that you will promptly inform Full Sail Partners of any changes related to current and updated Customer information (including changes to name, address, email address, postal address, phone and fax numbers, change of expiration date or account number, etc.) to be used by Full Sail Partners to contact you regarding the Services and otherwise as necessary in regards to the status of services, as well as notifying contacts throughout the Term of this Agreement for notices and/or updates from Full Sail Partners.

Application and information
Vision Unleashed and any information or software contained or referred to therein, and throughout these terms and conditions this means to include without limitation all names, facts, figures, procedures, images, graphics and any other type of content whatsoever, is provided “AS IS”, “WITH ALL FAULTS” and on an “AS AVAILABLE” basis without any representations or warranties of any kind, whether express or implied by law, to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, merchantability, non-infringement, compatibility, security, effectiveness, reliability, timeliness, accuracy and completeness, and without any obligation on our part, whether express or implied, to ensure that Vision Unleashed and any such information or software contained or referred therein meet any expectation or requirements whatsoever.
Results
We do not make any representation or warranty, whether express or implied by law, to the extent permitted by law, that the results that may be obtained from the use of Vision Unleashed and any information or software contained or referred to therein will be of satisfactory quality, fit for a particular purpose, merchantable, non-infringing, compatible, secure, timely, accurate or complete.
Access and security
We do not represent or warrant, and hereby disclaim any representations or warranties, whether express or implied by law, to the extent permitted by law, that the provision of and access to Vision Unleashed and any information or software contained or referred to therein will be accessible, uninterrupted or error-free, that defects will be corrected, or that Vision Unleashed or the server that makes it available are free of viruses or other harmful components, or that you have the ability to transmit and receive information from or through Vision Unleashed .
Liability
The information provided herein is to be used entirely at your own risk. In no event shall we or our principals, owners, officers, managers, employees, representatives, contractors or agents be liable for any direct, indirect, incidental, special, exemplary, punitive, or consequential loss, injury or damage of any kind whatsoever (including without limitation loss of data, loss of revenue or anticipated profits, loss of business, loss of opportunity, loss of goodwill or injury to reputation and losses suffered by third parties), however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise), arising in any way out of or in connection with the provision of or any access to, use of or participation in Vision Unleashed and any information or software contained or referred to therein, or any copying, display or other use thereof or the submission or contribution by you of any information to us or Vision Unleashed, irrespective of whether such loss, injury or damage was foreseen, foreseeable, known or otherwise or whether we have been advised of the possibility of such loss, injury or damage, except only in the case of death or personal injury where and solely to the extent that applicable law requires such liability on our part. Your sole and exclusive remedy for any dispute with us is to discontinue your access to, use of and/or participation in Vision Unleashed and any information or software contained or referred to therein. You expressly agree that in no event shall any liability on our part exceed the total amount of service fees that you paid us during a one-year period for access to, use of or participation in Vision Unleashed and any information or software contained or referred to therein or an amount of $1 (one dollar), whichever is less.
Indemnification
Upon a request by us, you agree to defend, indemnify, and hold harmless us and our principals, owners, officers, managers, employees, representatives, contractors or agents from any and all liabilities, losses, claims and expenses, including attorney’s fees that arise from your use or misuse of Vision Unleashed or any information or software contained or referred to therein or your violation of these terms and conditions, without any obligation on our part to follow any instructions, directions or suggestions made by you. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.
Intellectual Property Rights
Vision Unleashed and any information or software contained or referred to therein is protected by and subject to copyright, design rights, trade mark rights and/or patent rights of us and/or of third parties. Without the express prior written consent of the respective owner of the relative intellectual property right, you are not permitted to use, change, modify, reproduce, distribute or publish any part of Vision Unleashed and any information or software contained in any manner or for any purpose whatsoever other than as is expressly allowed in these terms and conditions. Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any license or right to use any patent, trademark, design right or copyright owned by us and/or any other third party. Framing Vision Unleashed or deploying other methods which similarly result in any part of Vision Unleashed being presented within another web site is strictly forbidden. Unauthorized use of any patent, trademark, design right or copyright may be prosecuted to the fullest extent permitted by law. You may not use any data mining tools, robots, or similar data gathering and extraction instruments on Vision Unleashed or any part thereof and may not circumvent any mechanisms included in Vision Unleashed for preventing the unauthorized reproduction or distribution of any part thereof.
Miscellaneous
Termination
Your right to use access or participate in Vision Unleashed and any information or software contained or referred to therein shall automatically terminate if you violate these terms and conditions. We reserve the right, in our sole discretion, to terminate your use of, access to or participation in all or part of Vision Unleashed for any reason, with or without notice. Notwithstanding any termination of your rights you shall continue to be obliged to comply with these terms and conditions and following any termination your obligations with regard to the use of, access to or participation in Vision Unleashed shall subsist.
The extent that your firm uses the Vision Unleashed service during your paid subscription period is up to you. If you decide to discontinue use entirely, your logins will remain available to you until the end of your subscription period. Refunds are not available unless you were denied use of the Tool by circumstances that were under the exclusive control of Full Sail Partners
Assignment
These terms and conditions shall inure and be binding upon the successors and assigns of the parties hereto. You are not allowed to assign or transfer any of your rights or obligations under these terms and conditions. We reserve the right to assign or transfer Vision Unleashed or any information or software contained or referred to therein to any third party without notice and without imposing terms to your benefit.
Entire agreement and severability
These terms and conditions constitute the entire agreement between you and us with respect to the subject matter herein and supersede any and all prior or contemporaneous oral or written agreements. If any part of these terms and conditions is held invalid or unenforceable, that part shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining parts shall remain in full force and effect.
Competent courts and applicable law
The parties agree this Agreement is governed by and construed under the laws of the State of Colorado, and Client agree that any dispute arising from or relating to this Agreement shall be brought in the exclusive jurisdiction of the state and federal courts of Denver County, Colorado. The prevailing party in any such proceeding shall be entitled to recover its costs and expenses incurred in such proceeding, including but not limited to reasonable attorneys' fees, witness fees and collections costs. You agree that hereby you are waiving any claims that you might otherwise have had based on the laws of any other jurisdiction.
